In Congolese law, there are several avenues of appeal that can be used to challenge a ruling issued by the higher courts.
To my knowledge, here are some remedies to note….

1. Application for review: It is possible to request a review of a judgment before the court that issued it. The review procedure allows a final decision to be challenged on the basis of new facts or serious procedural defects.

2. Third-party opposition action: This action may be used when one of the parties discovers, after a judgment, a decisive piece of evidence which was not known at the trial and which could have influenced the judgment rendered.

3. Action for annulment: It is possible to request the annulment of a judgment rendered by a high court before the Court of Cassation. This action may be based on grounds such as the incompetence of the court, violation of the law or violation of the rights of the defense.

4. Appeal in cassation: An appeal in cassation allows a court to challenge its decision on the basis of an error of law. It must be filed with the Court of Cassation within a specified time limit from the notification of the contested decision.

5. Appeal to the Constitutional Court: If a court's ruling violates constitutional rights, it is possible to appeal to the Constitutional Court. The latter is competent to review the conformity of laws and regulatory acts with the Constitution.

Regarding case law, it is important to consult the decisions handed down by the highest Congolese courts, such as the Constitutional Court, the Court of Cassation, the High Military Court, and the Council of State. These decisions serve as a reference for interpreting and applying Congolese law. You can access case law by consulting specialized legal databases or by referring to the official publications of the relevant courts.

I bow to the great legal minds of this forum.
