INTRODUCTION

At a time when the Democratic Republic of Congo is going through a crucial stage in its existence, following the peaceful transfer of powers resulting from the organization of the presidential and legislative elections at both the national and provincial levels on December 30, 2018, the country's development remains one of the major concerns of the new political class. Achieving this development will necessarily involve several avenues. But public procurement constitutes, among other things, the path par excellence that our leaders must take to properly establish their policies, for the simple fact that development programs are, most often, carried out through them.

While public procurement is understood as written national or international contracts concluded for consideration between contracting authorities, public bodies, and contractors, suppliers or public or private service providers with a view to either carrying out works, or supplying goods, or performing current or intellectual services within the framework of the relevant legislation, the public procurement system is defined as the abstract whole whose elements are coordinated by a law, theory with the aim of preparing, entering into and executing public contracts?
